Jacques Weber Inform News ("JWI.NEWS") is an area-based news source which strives to provide the community and its subscribers with accurate and up to date news and information.
Any person ("user") that accesses, subscribes or downloads information via the JWI.NEWS application platform or website, will be bound and agree to be bound to the JWI terms of use, disclaimers and limited liability clauses.
These Terms and Conditions shall regulate the relationship between JWI.NEWS and visitors ("User") to the company's Website and information via the application, Facebook or website "the Platform".
Subscription to the Platform will consist of a monthly payment of R45.00 (Fourty Five Rand), which will be processed via a 3rd party app Payfast. Every month the user’subscription will renew automatically. Cancellation of a subscription can be made at any time but will only be processed at the end of every month. Cancellation can either be done via e-mail or on the user’s profile on the Platform.
By accessing and using the Platform, the User agrees to be bound by the Terms and Conditions set out in this legal notice as outlined in terms of section 11 of the Electronic Communications and Transactions Act 25 of 2002. If the User does not wish to be bound by these Terms and Conditions, the User should not access, display, use, download, and/or otherwise copy or distribute Content obtained on the Platform.
Updates and Amendments to the terms and conditions
JWI.NEWS reserves the right without notice to change, modify, amend, add to or remove portions or whole parts of these Terms and Conditions from time to time permanently or temporarily. All updates and/or amendments to the Terms and Conditions are effective on the date JWI.NEWS publishes them on the Platform. The responsibility is on the User to determine whether any updates and/or amendments have been made on these Terms and Conditions. The continued use of the Platform by the User after the updates and/or amendments have been made to the terms and conditions, has the effect of the User agreeing to be bound by the new Terms and Conditions.
This Platform is controlled, operated and administered within the Republic of South Africa. The User may not use the Platform in violation of South African export laws and regulations. If the User accesses the Platform from locations outside of South Africa, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
Should a dispute arise relating to the Platform or the contents thereof. The dispute shall be submitted for arbitration in Cape Town before one arbitrator in accordance with the provisions of the Arbitration Act no. 42 of 1965. The award by the arbitrator shall be binding on all the parties involved. Notwithstanding the arbitration, this provision does not constitute a waiver by JWI.NEWS on using any other competent court with jurisdiction to certain matters. JWI.NEWS may seek appropriate relief at a High Court of South Africa and the User hereby consents to the jurisdiction of the Western Cape High Court should such a scenario arise.
In the event that only part of these Terms and Conditions are found to be invalid, unlawful or unenforceable, such terms shall be severable from the remaining Terms and Conditions, which shall remain valid and enforceable.
Any indulgence, leniency or extension of time which JWI.NEWS may give to the User shall not operate as an estoppel or in any way prejudice JWI.NEWS or preclude JWI News from exercising any of its rights in the future.
The Terms and Conditions expressed above constitutes the whole agreement and JWI.NEWS and User are bound by the Terms and Conditions herein.
JWI.NEWS does not intend to be used or warrant itself as an emergency reporting platform and cannot be held liable for any loss, damage or injury whatsoever that arises out of the user attempting to use it as an emergency reporting platform.
Any action taken by the user relying on the information provided is strictly at the user’s sole and exclusive risk. JWI.NEWS will not be held liable for any losses, injury and/or damages that arise out of this action.
JWI.NEWS intends for the information and data contained on the Platform or provided via other channels, including but not limited to phone, email and the application, to be accurate, factual and reliable, however, since the information and data has been compiled and/or obtained from independent sources, it is provided by JWI.NEWS on an "AS IS" and "AS AVAILABLE" and may contain inaccuracies and typographical errors.
JWI.NEWS publishes all information in good faith and with the intention for use of general information purposes only. JWI.NEWS makes no representations or warranties, express or implied, about the completeness, reliability and accuracy of this information.
The JWI.NEWS Platform may contain hyperlinks linking the user to external and/or independent websites and sources. Whilst JWI.NEWS strives to provide quality links to websites with factual and ethical information, JWI.NEWS has no control over the content and nature of these websites and expressly excludes any liability associated with the use thereof. JWI.NEWS receives various types of information (‘the Information’) from Users who access the Platform. JWI.NEWS makes every effort to protect any Information received by it as outlined in section 51 of the Electronic Communications and Transactions Act 2002. Despite such undertaking, it is possible for Internet-based communications to be intercepted. Without the use of encryption, the Internet is not a secure medium and privacy cannot be ensured. Internet e-mail is vulnerable to interception and forging. JWI.NEWS will not be responsible for any damages the User or any third party may suffer as a result of the transmission of confidential information that you make to JWI.NEWS through the Internet, or that you expressly or implicitly authorize JWI.NEWS to make, or for any errors or any changes made to any transmitted information.
The User may visit the Platform without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent on the Platform, pages viewed, etc. JWI.NEWS uses this information to determine use of the Platform, and to improve content thereon.
The User acknowledges and understands that JWI.NEWS may be required in law from time to time to monitor the content and user traffic of the Platform and shall provide evidence of the same to authorized officials.
